By accessing or using the Byoond website or services, you agree to these Terms of Service. These Terms cover both our consulting and project services and our software products, including Loomy Hub.


Services

Byoond provides digital services including website development, landing pages, automation solutions, AI powered tools, strategic consulting, and software products such as Loomy Hub.


The scope, pricing and timeline of services are defined per project or agreement.

Loomy Hub is a Byoond product that combines financial management, AI-powered WhatsApp Business communications, and AI-assisted marketing content. It operates exclusively through the official Meta WhatsApp Business Platform.


Client responsibilities

Clients are responsible for:

  • Providing accurate and timely information

  • Approving deliverables within agreed timeframes

  • Ensuring content provided does not infringe third party rights

  • For Loomy Hub WhatsApp users: maintaining lawful basis for processing end customer data, obtaining opt-in when required, and respecting opt-out

  • Complying with Meta WhatsApp Business Messaging and Commerce Policies

  • Not using the service for spam, harassment, fraud or content that violates applicable law


Violations may result in suspension of the service.

Use of artificial intelligence

Several Byoond services use AI components (including Claude by Anthropic) to support responses, content or automation. Clients acknowledge that AI outputs may contain errors and should be reviewed before acting on them in critical contexts. The agents deployed via Loomy Hub on WhatsApp are task specific and do not function as general purpose AI companions, in compliance with Meta's policy. We do not use client data to train AI models without specific written authorisation.


Service availability


Byoond uses reasonable efforts to maintain service availability but does not guarantee uninterrupted access. Third party outages (Meta, cloud providers, AI providers) and force majeure events may affect availability. Byoond may suspend access for policy violations, fraudulent use, or non-payment, with notice and opportunity to remedy when possible.


Intellectual property

Unless otherwise agreed in writing:

  • Final deliverables become the client's property after full payment

  • Byoond retains the right to showcase work for portfolio and promotional purposes

  • Software products owned by Byoond (including Loomy Hub source code and architecture) remain Byoond's intellectual property. Clients receive a licence to use the product under the agreed terms.


Payments and refunds

Payment terms are defined per proposal or invoice. Refunds are not guaranteed and are assessed case by case depending on the stage and nature of the service.

Data protection


Byoond is committed to protecting personal data. Our Privacy Policy describes how data is handled, the lawful bases, retention, security and your rights under Brazilian and Australian privacy law.


Limitation of liability


Byoond is not liable for:

  • Loss of revenue or business

  • Indirect or consequential damages

  • Results dependent on third party platforms, tools or user behaviour

  • Outages or policy changes imposed by third parties such as Meta

  • AI output errors when used without appropriate human review


To the maximum extent permitted by law, Byoond's total liability is limited to the fees paid by the client in the 12 months preceding the event giving rise to the claim.

Governing law


These Terms are governed by the laws of Australia. When services involve processing personal data of individuals located in Brazil, the Brazilian General Data Protection Law (LGPD) applies. Disputes will be resolved through good faith negotiation first and through Australian courts as the second step.
